Welcome to Hӓfele America Co.’s (“Häfele”) Trademark and Brand Policy page.  We’re thrilled that you’ve discovered the visionary entrepreneurial spirit of Häfele’s passionately consumer-focused products.  Below you’ll find our guidelines, so that you can interact with the Hӓfele brand correctly.
 

Usage Guidelines
Hӓfele’s trademarks and trade dress are protected in the US and internationally, and may not be used without the written permission of Häfele America Co.  Häfele’s trademarks include, but are not limited to, Häfele, our Häfele logo, and other graphics, phrases or images that identify the source or origin of Hӓfele’s product and services.  You must not alter or modify the marks or use them in a confusing way that suggests that Hӓfele sponsors or endorses you or your products or services, or confuses the Hӓfele brand with another brand.

You may make fair use of our Hӓfele wordmarks (Hӓfele) to: (1) make factual statements about Hӓfele, our products and services, or (2) truthfully communicate your interest in Hӓfele’s products, services or original Hӓfele media.

Accessories, Applications, and Merchandise
Häfele does not permit the use of our marks on accessories, applications or merchandise (or anything else). Merchandise includes anything you create or build such as: t-shirts, hats, balloons, lighting, cabinets, etc.  We love your enthusiasm for our products but please don’t put our marks (including word marks and logos) on your custom creations.

Websites
Please do not apply for a trademark containing HӒFELE or one of our other marks, and do not use HӒFELE in your website name or register a domain name that contains HӒFELE or misspellings or other variations of our marks.  Your website must not copy the distinctive Hӓfele look and feel, as we do not want anyone to be confused about whether it’s your site or our site.

Buy from an authorized retailer, reseller, or distributor of our products.
We take the protection of our brand very seriously. Authentic Hӓfele products are available worldwide. By purchasing your Hӓfele products from an authorized retailer, reseller, or distributor, you are helping us maintain the authenticity of our brand.

Häfele America Co. (“Häfele”) does not allow web sites that use frames to link to any page on this site without prior written permission from Häfele.  In addition, no portion of this site may be reproduced in any form, or by any means, without prior written consent from Häfele America Co.

Specifiers and designers interested in specifying Häfele products are allowed to download and reproduce images, specifications or text for use in presentations and proposals to customers and potential customers, on the condition that full credit and attribution be given to Häfele America Co. for any such reproduction and use.

Häfele America Co. E-Commerce Policy for Authorized Häfele Online Resellers
 

To qualify and remain a Häfele America Co. Authorized e-Reseller, your business must adhere to this Häfele Authorized Reseller Policy at all times.
 

1. Maintain Current Business Information & Disclose All Locations That Carry Häfele
Maintain accurate and up-to-date company information and disclose all retail locations that carry Häfele products throughout the term of your reseller relationship with Häfele.

Qualifying retail locations can only be one of the following: your physical brick & mortar store(s), your commerce-enabled website(s), or temporary storefronts (events, tradeshows, pop up stores, etc.).

2. Sell on Approved Retail Website(s) Only
Must only take orders via publicly accessible ecommerce enabled web pages hosted on approved websites owned and operated by your company. Site is clearly identified as a reseller site and not represented as a Häfele store.

Selling on 3rd party sites (such as eBay, Amazon, Alibaba, etc.), drop-ship accounts (such as Buy.com, Newegg.com, Overstock.com, etc.), classified sites (such as Craigslist.com, Facebook Marketplace, etc.) or direct messages on forums is strictly prohibited.

3. Report Sell-Thru
Provide sell-thru information by SKU and approved retail location upon request. Häfele reserves the right to perform an audit of financial statements pertaining to Häfele sales or the business operations (conduct) to ensure compliance with this policy.  You agree to cooperate and provide access to records, upon reasonable notice, to facilitate this review by Häfele.

4. Häfele’s Trademark & Brand Policy
Must agree to comply with Häfele’s Trademark & Brand Policy and represent yourself as a Häfele Authorized Reseller in all online advertising & sales collateral.

Setting up businesses, registering domain names, or social media usernames that contain any of Häfele’s trademarks is strictly prohibited. To ensure compliance with Häfele’s Authorized Reseller Policy, you must only use approved marketing materials for all Häfele products.

5. Häfele’s Minimum Advertised Price Policy
Ensure you understand and abide by Häfele’s Internet Minimum Advertised Price (I-MAPP).  You can read the I-MAPP Policy in its entirety on this website.

6. Sell to Retail Consumers Only
You may not sell in bulk to business (“B2B”) accounts, wholesalers, or freight forwarders/drop-shippers for other retailers. You may only sell Häfele products to your end consumers only.

7. Only Purchase Häfele Products Directly From a Häfele Assigned & Authorized Distributor
You may only buy Häfele products from Häfele approved Assigned & Authorized Distributors.

8. Only Sell Häfele Products in Original Packaging
Do not alter original Häfele packaging in any way prior to reselling Häfele products. Removing Häfele products from packaging and reselling Häfele products in different packaging or under a different name is strictly prohibited.

9. Separate Ecommerce Business from Offline Retail
You must have the ability to plan inventory for your ecommerce business separately from inventory planned for your physical store’s business & provide accurate sell-thru numbers for each.

10. Use Known 3rd Party Shopping Carts
You must use a known 3rd party shopping cart system on all commerce-enabled websites owned and operated by your company.

11. Ensure Payment Card Industry (“PCI”) Standards Compliance for Credit Card transactions
You must ensure and certify PCI compliance for all approved commerce-enabled websites owned & operated by your company.

12. Maintain Updated Privacy Policy
You must publish and maintain a publicly accessible privacy policy.

13. Use Häfele Supplied Core Product Data in Feeds
You must be able to use a standard set of Häfele supplied data in product data feeds that you distribute to 3rd party advertising venues unless prior written permission is obtained by Häfele in advance.

14. No Bundling Häfele Products without Obtaining Permission
You must not re-SKU or bundle Häfele products in your online assortments & data feeds without receiving prior written permission from Häfele.

15. Provide Customer Service
You must offer live customer service Monday through Friday from 8 AM to 5 PM EST available through an 800 number to assist customers with sales.

16. Obey the Law; Abide by Policy Rules & Serve Customer Needs
You must comply with all applicable laws, rules, regulations & policies related to advertising, sale, and marketing of Häfele products. You must provide a level of sales support & customer support for our customers that, at a minimum, demonstrate industry best practices.

Failure to comply with all of the terms in Häfele’s Authorized e-Reseller Policy will result in suspension or termination of your account.

Häfele America Co. Internet Minimum Advertised Price Policy

Häfele America Co. (“Häfele”) is part of an internationally networked group of companies for furniture fittings, architectural hardware and electronic locking systems with 37 subsidiaries on five continents (“Häfele Group”).  The Häfele Group devotes substantial resources into developing its products and brand works through distributors who market our products based on the product qualities.  Häfele has adopted this Internet Minimum Advertised Price Policy (I-MAPP policy), which is applicable to every and all authorized Häfele e-resellers in the United States (“authorized e-reseller” or authorized e-resellers”) to support the brand as a premium offering and to provide authorized e-resellers the incentive to promote the brand and its quality products.  Häfele will not deal with e-resellers that advertise Häfele products at prices below our I-MAPP pricing for those products.
 

Policy
All Häfele products are subject to the I-MAPP policy.  The current listing of products and applicable I-MAPP prices will be sent to authorized e-resellers electronically.  A  listing will be considered to have been received within 48 hours from the sending date.  I-MAPP prices may be changed from time to time at Häfele’s sole discretion.  Authorized e-resellers are responsible for remaining current with the I-MAPP policy, products and pricing.  Each advertisement below the I-MAPP policy will be a violation of the policy.
 

Scope
The I-MAPP policy applies to any and all advertisements of Häfele products in any and all media including, without limitation, flyers, posters, coupons, mailers, inserts, newspapers, magazines, catalogs, mail order catalogs, emails, Internet or similar electronic media, television, radio and public signage.  The use of auction sites violates this policy.
 

Advertising
Advertising shall not include language or graphics that state or suggest that a Häfele product is being promoted at a price less than the I-MAPP policy price.  For example, it would violate the policy to:

a. Show the price of the product with a slash line through it in a manner that states or suggests that the advertised offer is less than the I-MAPP price.

b. Advertise “$X off” or “X% off” in a manner that states or suggests that the advertised offer is less than the I-MAPP price (i.e., unless I-MAPP products are specifically identified as excluded from the offer).

c. Advertise any product as a “free” or “gift” item. (Offers of “free shipping” are not prohibited under this policy.)

d. Advertise a bundle including any product in a manner that suggests that the Häfele product is being offered at a price below the I-MAPP policy.

e. Use language such as “Sale Price” or “New Low Price” or words such as “Subtract,” “Less” or “Marked Down,” in a manner that states or suggests the advertised offer is less than the I-MAPP price.

f. Include language such as “Price Too Low to Print,” “our manufacturer won’t let us tell you the price,” or “call for price.”

g. Use language such as “click for price” or “move to shopping cart to see price” feature on a website in a way that suggests that the actual price is lower than the I-MAPP price.
 

Actual Sales Price
This policy applies only to advertised prices and does not relate to actual sales prices of any item.  Each authorized e-reseller remains free to establish their own resale prices and to sell Häfele products at any price it chooses.  Häfele does not seek any e-reseller’s agreement on minimum selling prices and no representative or employee of Häfele is authorized to accept any such agreement from a distributor.  Any Authorized e-reseller who believes that a Häfele representative has sought such an agreement should notify Häfele immediately at hafeleservice@hafele.us
 

Modification
Häfele reserves the right at any time to modify, suspend or discontinue the I-MAPP policy in whole or in part or designate promotional periods during which the terms of the policy change or designate periods of time during which the policy is not applicable.  Policy modifications shall be communicated to authorized e-resellers electronically.
 

Mistakes and Exceptions
There are no exceptions to the policy and Häfele personnel have no authority to modify or grant exceptions to this I-MAPP policy.  An authorized e-reseller is responsible for its advertising and Häfele does not have the resources to determine whether a violation is intentional or accidental.
 

Enforcement and Interpretation
Häfele will enforce this policy through its own staff, outside consultants and agents and its legal representation.  Häfele will unilaterally and in its sole discretion make all determinations relating to a violation of the I-MAPP policy in its sole satisfaction.  All matters of interpretation and application of the terms of this policy shall be made solely by Häfele.  There will be no warnings, threats, discussions, negotiations or appeals.


Consequences
Häfele will determine the appropriate consequence for each violation in its sole discretion.  Consequences will include suspension of shipments on any or all products included in a noncompliant advertisement; suspension of shipments of a broader class of products; suspension of all product shipments; removal from the Häfele website as an authorized e-reseller, and/or termination of all sales.
 

Effective Date
This I-MAPP policy is effective January 1, 2015
 

Transition Rules
During the initial implementation of this policy, Häfele may notify authorized e-resellers of noncompliant advertisements.  If the advertisement is online, then an authorized e-reseller’s failure to withdraw or modify the noncompliant advertisement within 24 hours of such notice will be considered an I-MAPP policy violation.  Häfele is not required to notify authorized e-resellers with such notice and Häfele reserves the right to apply this policy without such notice.
